Agreement to Terms
These Terms and Conditions constitute a legally binding agreement between you and Drain Masters (“we,” “us,” or “our”) regarding your use of our drainage and plumbing services. By engaging our services, you accept and agree to be bound by these terms.
Services Provided
Drain Masters provides drainage and plumbing services including but not limited to:
- Blocked drain services
- Drain and sewer cleaning
- Plumbing services and repairs
- CCTV video pipe inspection
- Water jet drain cleaning
- Drain unblocking services
- Emergency drainage services
Service descriptions on our website represent general information. Specific service requirements are determined during on-site assessment.
Quotations and Pricing
Quotations provided are estimates based on information available at the time. Final pricing may vary based on actual conditions discovered during service delivery.
Quotations remain valid for 30 days from the date of issue unless otherwise specified.
We reserve the right to adjust pricing if site conditions differ significantly from initial assessment or if additional work becomes necessary to complete the service properly.
Payment Terms
Payment is due upon completion of services unless alternative arrangements have been made in writing prior to commencement of work.
We accept cash, electronic funds transfer (EFT), and card payments where facilities permit.
For commercial clients, payment terms of 30 days may be arranged subject to credit approval and completion of account application procedures.
Late payments may incur interest charges at the maximum rate permitted by South African law.
Service Appointments and Scheduling
Appointments are scheduled based on availability and the nature of the service required. Emergency services receive priority scheduling.
We make every effort to arrive within scheduled time windows but cannot guarantee exact arrival times due to the unpredictable nature of drainage emergencies and travel conditions in Gauteng.
Clients must provide reasonable access to the property and affected areas. Failure to provide access may result in rescheduling fees.
Cancellations and Rescheduling
Cancellations made with less than 24 hours’ notice may incur a cancellation fee to cover scheduling and mobilization costs.
We reserve the right to reschedule appointments due to emergency situations, equipment failure, or circumstances beyond our control.
Property Access and Safety
Clients must inform us of any known hazards on the property including aggressive animals, structural damage, electrical hazards, or contamination risks.
We require safe access to work areas. We may decline to perform services if safety conditions are inadequate.
Clients are responsible for securing valuables and moving items that may obstruct work areas.
Scope of Work
Our services address the specific drainage or plumbing issues identified during assessment. We are not responsible for pre-existing conditions unless explicitly included in the agreed scope of work.
Additional problems discovered during service delivery will be brought to your attention. We require authorization before proceeding with work beyond the original scope.
Equipment and Access Points
We access drainage systems through existing cleanout ports, inspection chambers, or fixtures. If adequate access points do not exist, creating them may require additional work and costs.
Clients are responsible for locating and exposing buried cleanout points or inspection chambers before our arrival if they are not readily visible.
Warranties and Guarantees
We guarantee our workmanship for a period of 30 days from service completion. This warranty covers the specific work performed and does not extend to pre-existing conditions, subsequent damage, or normal wear and tear.
Equipment and materials installed carry manufacturer warranties. We facilitate warranty claims but are not responsible for manufacturer defects or warranty limitations.
Our warranty does not cover:
- Blockages caused by improper use after service
- Damage from tree root regrowth (roots will naturally regrow and re-enter pipes)
- Problems arising from pipes that were already damaged or deteriorated
- Issues resulting from actions by third parties after our service
Limitations of Liability
Drain Masters’ liability is limited to the amount paid for the specific service in question. We are not liable for consequential, indirect, or incidental damages.
We are not responsible for damage to pipes, fixtures, or property that results from pre-existing deterioration, hidden defects, or conditions that could not reasonably be detected during standard inspection.
We carry public liability insurance for damages directly caused by our negligence during service delivery.
Client Responsibilities
Clients must:
- Provide accurate information about the problem and property conditions
- Disclose known hazards or special circumstances
- Ensure property access during scheduled appointments
- Make payment according to agreed terms
- Follow maintenance recommendations to prevent future problems
Drainage System Limitations
Drainage systems have limited capacity and lifespan. Our services restore function to existing systems but cannot make old or undersized systems perform beyond their design limitations.
We advise on system condition and limitations but are not responsible for inherent design flaws, inadequate capacity, or age-related deterioration.
Camera Inspection Footage
Video footage from CCTV pipe inspections is provided for documentation purposes. Footage quality depends on pipe conditions including water levels, debris, and lighting limitations.
We retain footage for our records. Clients receive copies but we are not responsible for long-term storage of client footage.
Emergency Services
Emergency services are prioritized based on severity, safety risks, and potential property damage. We define emergencies as situations involving:
- Active sewage backup into living spaces
- Burst pipes causing flooding
- Complete loss of toilet facilities
- Situations posing immediate health or safety risks
Non-emergency situations presented as emergencies may incur standard service rates rather than emergency rates.
Permits and Regulations
Clients are responsible for obtaining necessary permits for work that requires them. We advise on permit requirements but assume no liability for permit violations.
All work is performed in accordance with applicable South African plumbing regulations and municipal bylaws.
Subcontracting
We reserve the right to subcontract portions of work to qualified specialists when necessary. Subcontractors work under our supervision and quality standards.
Intellectual Property
All content on the Drain Masters website including text, images, logos, and service descriptions is owned by Drain Masters or used with permission. Unauthorized use is prohibited.
Privacy and Data Protection
We collect and use personal information in accordance with South African privacy laws including the Protection of Personal Information Act (POPIA). See our Privacy Policy for details.
Dispute Resolution
Disputes should first be addressed through direct communication with our management team. We are committed to resolving concerns promptly and fairly.
If direct resolution fails, disputes will be resolved through mediation or arbitration before resorting to litigation.
These terms are governed by the laws of South Africa. Any legal proceedings will be conducted in courts having jurisdiction in Gauteng.
Indemnification
Clients indemnify Drain Masters against claims, damages, or expenses arising from:
- Inaccurate information provided by the client
- Failure to disclose known hazards or conditions
- Client actions that interfere with proper service delivery
- Third-party claims related to client property or actions
Force Majeure
We are not liable for delays or failure to perform services due to circumstances beyond our reasonable control including natural disasters, strikes, riots, government actions, or other force majeure events.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
Changes to Terms
We reserve the right to modify these terms at any time. Changes become effective upon posting to our website. Continued use of our services after changes constitutes acceptance of modified terms.
For services already quoted or in progress, the terms in effect at the time of quote acceptance apply.
